Why Pre-1960 Buildings Need Lead Testing

Lead-based paint was widely used in buildings constructed before 1960. In 1978, lead paint was banned for residential use, but millions of pre-1960 buildings still contain lead paint beneath newer paint layers. NYC requires regular lead inspections for these buildings under multiple local laws.

NYC Laws Affecting Pre-1960 Buildings

Local Law 1 of 2004

Requires annual lead paint inspections for all apartments in buildings with 3+ units built before 1960. Applies to Class A residential dwellings.

Local Law 31 of 2020

Extends Local Law 1 requirements. All owners of buildings with pre-1960 apartments must have XRF testing completed (deadline was August 9, 2025).

Local Law 111 of 2023

Requires dust wipe testing after any lead remediation work. Also requires testing in common areas of pre-1960 buildings.
